Curaçao Promised Stronger Regulation. Does LOK Fulfil that Promise?

Under the new law, the Curaçao Gaming Authority (CGA) gains exclusive control over licensing, compliance, and oversight. There will no longer be sub-licenses under master-license holders. The direct licensing and centralised regulation bring oversight under one roof, with the CGA handling all applications, audits, renewals, and enforcement. Under LOK, operators can choose from several license categories:

Supplier License
Nonprofit Game License
Certificates for Service Providers

Operators now handle stricter AML and KYC checks where they must verify player identities, monitor transactions, and push for responsible gambling with self-exclusion and deposit caps.

Costs will climb too, as new licensees pay not just application and annual fees, but also domain fees and due diligence charges. Operators with an existing sub-license have a 12-month transition period to migrate to direct licensing. Failure to comply will result in license revocation.

Facts More Trust but Also More Barriers

The new law is named “no more grey-area operators”, giving the license a stronger reputation in the iGaming landscape. Proponents say that LOK improves credibility, and it reassures players, banks and investors.

The CGA is now facing a sudden surge of applications. Reports indicate that hundreds of operators are transitioning from the old system, while many new applications are also being received. But operators need to stay patient because tighter controls mean processing applications takes longer.

Startups and small operators can qualify for exemption under specific conditions, such as:

Businesses incorporated within one year of applying for a license.
If Ultimate Beneficial Owners (UBOs) have not been linked to another gaming software provider in the past two years.
Companies with annual gross gaming revenue below ANG 20 million for the first three years.
If an operator cannot hire local key personnel or secure an office in Curaçao, then they may qualify for a temporary two-year exemption, granted by the Minister of Finance.

Those who receive the exemption must still comply with the regulations of Curaçao. Over time, this could transform Curaçao from a historically criticised license into a widely acceptable, compliance-focused alternative.

Payments Stronger Regulation Comes at a Cost

The Landsverordening op de Kansspelen law promises a far more rigorous and transparent regulatory framework for Curaçao's online gambling industry. Whether they will fulfil the promise depends on the operator's scale and willingness to meet stricter requirements.

Established operators get a boost in their legitimacy and trust, while smaller or newer entrants face higher financial and administrative hurdles. This means that LOK tightens regulation and weeds out part of the market all at the same time.

Curaçao followed through on its promise. While LOK sets stricter rules, no one knows yet how well enforcement will hold up over time. Some critics have pointed out real concerns, as there is only so much capacity and limited oversight.
