KSA Strives for Pro-Consumer and Pro-Provider Marketplace

In 2024, the Kansspelautoriteit (KSA) introduced stringent new regulations aimed at strengthening consumer protection measures amid rising concern about gambling addiction. KSA has since focused on safeguarding the integrity of the regulated market by cracking down on unlicensed operators. 

The new measures implemented by the Dutch gambling regulator included strict deposit limits, mandatory affordability checks, and real-time player monitoring to ensure that operators actively intervene when signs of addiction become apparent. 

 KSA’s New Player Protection Rules Showing Promise 

In addition to the previously mentioned regulations, a ban on untargeted advertising and sports sponsorships was also introduced, aimed at reducing the appeal of gambling through the use of role models or high-profile athletes. 

By tightening the rules for licensed operators and improving enforcement against illegal offshore betting websites, the KSA aimed to close any loopholes allowing black-market operators to gain a foothold in the market. 

The KSA conducted research into the effectiveness of various measures introduced in 2024 to better protect players within the online gaming market.

The study showed that the new regulations had a positive effect. The number of high losses per gaming account decreased, and the channelisation rate (the share of players who only play with legal operators) showed a slight decrease but remained high at 92%.

Limit Changes Are Making a Difference

The Ministry of Justice and Security made it mandatory for players to contact the operator before setting a deposit limit of more than €150 for young adults or €350 per month for those aged 24 and older, so that the operator can inform the player of the risk associated with setting such a high limit. This resulted in the number of players setting high deposit limits dropping to below 50%.

The limits on net deposits have also proven effective. When depositing €300 in the case of young adults or €700 for others, the operator checks whether the player can afford the amount, and if this is not the case, the operator must block further deposits for the rest of the month. The result of this policy was that the percentage of players who deposit more than the deposit limits dropped from 9.7% to 2.2%. 

The lower deposit limits have also reduced the average loss per player account by 31%, from a monthly average of €116 to €80 since implementation.

Before the introduction of the new rules, approximately 4% of players lost more than €1,000 on average. That is now 1%, showing that the new policy ensures that excessive gambling occurs less frequently with licensed operators.
