Licensed Gambling Saves a Swedish Player Millions

Both courts found that Betsson had actively encouraged the player to gamble by using incentives and bonuses. This occurred between 2009 and 2014, before the reregulation of the Swedish online gaming market in 2019, during which time the player deposited SEK 174 million (€15 million) and ultimately lost a total of SEK 8.4 million (approximately €727,000).

The Supreme Court found that the contract between Betsson and the player should be invalidated because the company was aware that the player suffered from serious gambling problems and yet continued to direct “intrusive marketing directly to the player for a type of game that is particularly risky”.

The court therefore concluded that it was “against good faith” to rely on the gambling agreements made during the period relevant to the case and ordered Betsson to repay approximately SEK 5.6 million (€500,000).
