Spribe Wins Critical Court Injunction in the UK

Spribe, the creators of the globally praised Aviator crash game, have been at odds with Georgia-based Aviator LLC since last year over claims of trademark infringement.

However, Spribe was not willing to roll over and submit to Aviator LLC’s whims. The company has continued the battle in the UK courts - and recently struck a critical blow against its adversary.

Not All Smooth Sailing for Spribe

We previously reported on the case, when the Court of First Instance in Georgia ruled against Spribe OÜ. The reason for the ruling was that they felt the company’s ‘Aviator’ copyright and trademark registrations were done in bad faith.

Given the popularity of Aviator Spribe and its publicly lauded financial success, the courts granted Aviator LLC compensation to the tune of $330 million. In addition, the company was instructed to stop using the Aviator name for its game.

Given their efforts in pioneering the crash game market segment and the worldwide recognition of their casino game, the company is not willing to comply with the cease and desist aspect of the ruling.

 Cashing In On Spribes' Success

Not willing to come to an agreement with Spribe over the use of its intellectual property (IP), Aviator LLC tried to use its victory to carve out a segment of the crash game vertical for itself.

An official company press release on 10 March 2025, announced that they had reached an agreement with Aviator Studios to develop a casino game in the crash vertical using its trademark.

Rather than simply building their own, unique crash game, the Aviator Studios website says:

It’s time to experience the game as it was meant to be played. Join us and take off with Aviator—the original crash game!

The reality is that Spribe developed the game; the claim that anything created by Aviator Studio qualifies as the “original crash game” based purely on its logo is baseless.

 The UK Sides with Spribe's Game Development

It seems that Aviator LLC might have pushed their luck a little too far in the eyes of the UK courts. While they won the IP case in Georgia, based on filing times and other intellectual property rights laws, a level of arrogance crept in that could come back to bite them.

In response to their attempts at claiming the crash casino vertical as their own and specifically targeting Spribe’s player base, the UK High Court delivered an interim injunction preventing Aviator LLC from launching its title in the country.

I am pleased that the highly respected UK Court supports our position and has granted an injunction preventing Aviator LLC from launching and promoting its copycat game.

The injunction states that Spribe’s game is the recognised entity in the UK gambling market and Aviator LLC is the one looking to abuse its reputation and goodwill. 

While this injunction does not restrict Aviator from applying for a gambling license, it will set the stage for an ongoing clash over who rules the skies over the UK and beyond.
